There is nothing quite like reading good books. Perhaps you especially enjoy reading good Christian books. There are certainly some wonderful old classics and very interesting new releases. The Christian community has produced a lot of different authors. With the release of the movie based on C.S. Lewis “Prince Caspian”, maybe the idea of reading or re-reading the Chronicles of Narnia popped into your mind. They are such good books. It would be nice to add the ability to engage in discussions and insights into the book as you read.

If you have ever had the opportunity to be involved in a Christian Book Club then you know that they can be a wonderful experience. It is fun to hear the things other people get out of the same book you are reading. Perspectives on the story that you might have missed become apparent in the midst of discussion. The problem with most book clubs is that they often start strong but then begin to fade. The reality is we live in a busy world and it becomes difficult to schedule times when everyone in the club can get together. If people miss a meeting because of a scheduling conflict or fall behind in their reading they will often just drop out of the group.

Starting a book club with an Internet component could be the best way to fix the problem of a traditional book club setting. A virtual book club that can be accessed when people have time and can leave their comments. This club could be open to people all over the world allowing for some great cultural view points.

For people who still want a more traditional book club setting, instead of trying to meet every week, a once a month meeting could be arranged where your local group can get together for some one on one discussion. The rest of the month, having an online component would allow people to read and stay connected in spite of busy schedules. It is much easier to add a once a month meeting into your schedule than a once a week meeting. You really don’t want to stretch a book out longer than a month.

You can either start your own online book club or you can join one that already exists and encourage your local group members to join up as well. Joining an online book club should be free. The advantage to joining a club that already exists online is that they will organize the book selections and keep the club running. Either way, the ability to read and discuss good Christian Books just got a little easier.

Feldman Law Center – Bob the Homeowner versus Net Present Value

Feldman Law Center – News by Feldman Law Center — A little known aspect of the Obama Administration’s “Making Home Affordable” plan is the “Net Present Value” test which essentially determines whether a loan modification or a foreclosure and sale will provide a better return for the investors behind the mortgage in question. The calculation takes the proposed monthly payment in a home loan modification and multiplies it over the life of the loan (payment x 12 months x 30 years). If that total comes in above what a sale and foreclosure would yield, the calculation would favor a modification. If it falls short, the calculation would lean toward foreclosure and sale.

Foreclosures in many scenarios will favor the investors while a modification often works to the advantage of the servicer. For the investor, a foreclosure and subsequent sale may result in a loss of principle but money coming back to the investor can be re-invested in other vehicles which can provide yield and returns. The disadvantage for the servicers is that, without monthly payments from the property, they lose the fees they were able to charge the investor for handling the payments, billing, and communication with the homeowner. A loan modification, on the other hand, benefits the servicer by keeping the payment stream, and the fees they can charge on it, alive. The modification hurts the investor by forcing a mark to market valuation which reflects the loss on the mortgage (also known as a haircut) due to a lower interest rate and, if applicable, a reduction in principle.  

The third party in the game is the homeowner (Bob) applying for the loan modification. It’s likely that the homeowner has heard of “Making Home Affordable” and is very aware of the 2% interest rates that were part of the headlines generated by the plan. Naturally, that’s the rate he wants. Unfortunately, getting Bob a 2% interest rate is not in the interest of either the investor or the servicer of his mortgage. For the investor, the lower the interest rate goes the bigger the haircut. Memorializing it in a modification will turn a theoretical haircut into an actual loss on the books. For the servicer, an interest rate at that low level can push the NPV score to a point where the test favors foreclosure over modification. If Bob’s property isn’t considered a lost cause it’s extremely unlikely that he’s going to see anything close to that 2% rate.

One of the other variables is Bob’s commission based income. His payments are going to be capped at 31% of his average monthly income, which has dropped considerably. In fact, it’s dropped so much that even by maxing his payment out at 31% of his monthly pay he falls below the estimated foreclosure and sale score. Conditions dictate foreclosure according to the net present value test.

The investor, seeing a score that clearly calls for foreclosure takes a look at sales statistics for Bob’s town and his neighborhood. Nothing is moving and foreclosure backlogs are growing. Average bids at auctions are coming in at less than 60% of the loan amount. Less than 2% of foreclosed houses are selling at auction. The estimate on what the property can realize in a foreclosure and sale is way too high for current conditions. If the house sells, and it’s a big if, it won’t be for anything near the price used in the NPV calculation. The investor decides to pull back on the foreclosure due to the regular hits he’s already taking in his portfolio and his aversion to putting another property into the portfolio. The pullback on the foreclosure doesn’t mean he’s going to allow for a modification, however. There’s a haircut waiting with the modification as well. This property is going to sit in limbo while things work themselves out.

There won’t be any communication regarding this stalemate between Bob, the servicer, or the lender. From Bob’s point of view the servicer’s people aren’t responsive and aren’t calling him back. The truth of the matter is that the servicer’s processors know as much about Bob’s situation as Bob does; not much. The sides settle in to the day to day of nothing happening which stretches to months.

The commentary from homeowners that have tried to modify their mortgages under the guidelines of Making Home Affordable runs along a thread very similar to that of our theoretical Bob. While much of the delay can be attributed to overload, staffing, and training issues at the lenders and servicers, the stalemate between servicers and their investors is bogging things down as well. The Safe Harbor Bill, passed by Congress in May, was aimed directly at this standoff. Its main objective was to remove the threat of lawsuits filed by investors when they felt that the servicers were acting on their own best interests in approving loan modifications.

While there may be a conflict of interest currently, neither side wants to go to war over this issue. Despite the increased autonomy given the servicers, it’s likely that they will still want to be on the same page with investors to preserve long standing relationships that have worked well over time. It therefore looks like limbo, status quo, and homeowners waiting for a knock on the door will rule the day and the near term.

Wanneer een huiseigenaar bezig is een onderneming om een lening te onderhandelen wijziging voor zijn rekening, het invoeren van een schuldenregeling proces kan verdubbelen of de daling van de maandelijkse betalingen triple opgedaan bij een lening wijziging door zelf . De schuldenregeling aspect van deze combinatie heeft een aantal voordelen in termen van de lening wijziging en de voordelen die zou buiten het toekomt:

1) Maandelijkse consument schulden / credit card betalingen gewoonlijk worden verlaagd met 50% binnen een maand na het starten van het proces.

2) De gedocumenteerde daling van de betalingen schuld van de consument maakt het algemene financiële beeld van de huiseigenaar kijken veel beter. Zoals geldschieters hun toepassingsgebied te verbreden om rekening te houden voor de consument en het vermogen om schulden te betalen na een lening wijziging zou de verminderde betaling als gevolg van de schuldenregeling het verschil tussen het krijgen van een lening van wijziging en wordt ontzegd.

3) Deelname aan een schuldregeling zal de credit score van de consument / huiseigenaar maar credit scores zijn niet de grootste factor pijn om te bepalen of een lening wijziging zal worden toegelaten of niet. Acceptatie voor de lening wijziging is vooral afhankelijk van het vermogen te betalen die zin dat een schuldenregeling, zelfs vergezeld van een dalende credit score, kunnen helpen om het geval voor een modificatie.

4) Het tijdschema voor de voltooiing van schuld nederzettingen varieert achttien-achtenveertig maanden gedurende welke tijd de credit score van de kredietnemer zal afnemen. Na verloop van tijd, aangezien elke rekening wordt betaald uit in de regeling de kredietwaardigheid van de kredietnemer score zal beginnen te stijgen. Tegelijkertijd zijn de eerste rente op een nieuwe lening wijziging typisch voor drie tot vijf jaar voordat betaling verhoogt start te gaan in werking. Should I Get A Law Degree?

Everyone has heard the old line “there are too many lawyers”.  While this may be true, the next question one must as is…why?  Why is pursuing law such a popular path to follow and what exactly are the benefits and negatives of pursuing a law degree?  In this article I’ll explore the ‘right’ reasons and also some ‘wrong’ reasons to pursue this time consuming and expensive undertaking.

The Love of Law

The first and ‘best’ reason to pursue a Law Degree is of course that you absolutely LOVE the law.  Do you sit up late at night debating controversial legal issues with your friends?  Do you find yourself getting into heated arguments over the right to fair trial of non-citizen combatants in the Iraq war or perhaps the various ethical and legal sides of the abortion issue.  Is your favorite channel C-span or Court TV and is your book shelf full of books about famous legal cases or issues? 

If this sounds like you then you might be law school material.  The best lawyers…and law students have a PASSION for the law.  They don’t look at reading 500 pages of a constitutional law book as work, they relish it.  While there are certainly other good reasons to go to law school, perhaps no other is as good a predictor of success as your love of the subject matter. 

Critical Thinking

One of the often overlooked but perhaps most important skills you learn by attending law school is the development of your critical thinking ability.  The ability to look at an issue from its various sides, do the research to fully understand the intricacies of an issue and the ability to argue and defend your position are incredibly valuable skills that will serve you for the rest of your life in and outside of the law field. 

Many attorneys find that the research and critical thinking skills help them in areas they never even considered from personal relationships to managing employees and building a business.  Of course these skills are crucial in the legal profession itself, but a legal education can be a great exercise in improving one’s ability to handle the complex negotiations of life.

Career Dynamite

Obtaining a law degree can be a tremendous asset when paired with a degree or specialized knowledge in another field.  By using your specific knowledge and experience and having a law degree you then are perfectly tailored to work as legal counsel for a plethora of fields. 

For instance a pharmacy degree paired with a law degree makes you a great asset as counsel in a firm that specializes in pharmaceutical firms.  Architecture, real estate or construction experience teamed with a law degree can make you a great real estate attorney.  The real world experience you possess in the specific field makes you an invaluable asset to law firms that might have top notch attorneys but little hands on, practical experience in that field.

Wrong Reasons

It is very important to be aware of the wrong reasons to pursue a law degree…and there are many.  Some people decide to go to law school because they simply don’t know what else to do.  Besides being an obvious waste of time, most often these people do not end up even working in the legal profession. 

Others want to become an attorney not because they really like law, but because they want the perceived ‘prestige’ that having a law degree attaches.  People that go to law school for this reason tend to have self-esteem issues and are looking to fill a void with the ‘title’ of lawyer even though they really have very little passion for the profession.  They often don’t really know what they want to do and think spending three years in school is a way of either staying out of the ‘real world’ or that they’ll ‘figure it out’ in law school.  Law school is so work intensive that is highly recommended you don’t attend unless you really know you want it for the right reasons.

Finally, there’s the money.  While any profession is ultimately responsible for giving you a pay check, potential law school candidates should be aware that the vast majority of lawyers don’t make gobs of money.  While it is true that if you attend a top, Ivy League school and get into a top firm you can make a very good living, this is really only something that a very small percentage will accomplish.  The big money starts if you make Partner in a firm, which is highly competitive and can take many years.  For those simply looking to make good money, there are other professions that are comparatively easier to accomplish this in finance and banking and without the need to attend law school.  However, if your passion is the law then there are certainly great financial rewards for those that position themselves correctly.  For more great articles and insights please visit www.LawDegree.me.
