Types of Power of Attorney Forms

A Power of Attorney is a legal document in which the writer appoints a person the right to act on his behalf. The authority you give that person depends on the specific language of the Power Of Attorney form. Sometimes people may make their power of attorney form very broad or sometimes may limit the appointee to very specific actions.

A Power of attorney can be used to give some one the right to sign a contract for you, make healthcare decisions, to handle your money or money transactions, the right to sell your home or car, and including any other legal right to do what the maker of the power of attorney can do themselves.

A “Limited Power of Attorney” gives the appointed delegate the authority to do a specific act, like only the authority to sell your home for you.

A “General Power of Attorney” usually gives the appointed delegate the very broad powers to perform any legal act on behalf of the maker of the Power Of Attorney. These are often times used to list activities you want the appointed delegate to perform.

A “Durable Power of Attorney” was created because Limited and General Power of Attorney terminate if the principal (maker of the Power of Attorney) becomes incapacitated. A Durable Power Of Attorney will not terminate it will continue to remain effective even if a person becomes incapacitated. In every state there are usually laws were a Durable Power of Attorney can no longer be used for an incapacitated principal in certain circumstances. A Durable Power Of Attorney must contain special wording that provides the powers given to the delegate to survive the incapacity of the principal. A Durable Power Of Attorney is effective as soon as the principal signs it unless it specifies that there are conditions but the conditions must be within your states laws.

How to Find The Right Divorce Lawyer For You

Finding the right divorce lawyer for your divorce is more than just blindly pointing your finger at the first family law advertisement you see in the yellow pages. If you have a lot to lose, common sense tells that it is necessary to pick a divorce lawyer who has experience and reputation of settling intricate cases that involve assets, property, custody, etc.

Selecting a divorce lawyer to handle your case can be one of the most important decisions when considering a divorce. The stress that divorce battles bring to parents can be truly remarkable. Your divorce lawyer will either add to your frustration or ease the pain. Here are a few tips to consider when looking for a divorce lawyer.

Fees – Lawyers charge a lot, don’t they? Yes, they go to a very lengthy and a difficult schooling, which at the end is worth a lot. Many people try to hire divorce lawyers that charge less for their services. On the total opposite, some people with a sizeable income would hire expensive or renowned lawyers. The assumption here is that high-priced lawyers can do a better job representing your case. This claim has never been verified. For example, a costly lawyer may have few wins in court, whereas a somewhat new divorce lawyer may have an excellent winning track record. So, during your initial consultation with your prospective divorce lawyer it is vital that you have an open and an honest discussion about the fees and what you can expect. But, the fees need not to be the determining factor in the final decision of who would represent your case.

Experience and expertise – Experience is one very important factor in choosing your divorce lawyer. Additionally, it’s necessary for that lawyer to practice primarily in the field of divorce law. In some cases, people will hire a lawyer who practices outside this field, thinking that any lawyer will do. An experienced divorce lawyer will know the tendencies of the various judges in your jurisdiction and will be able to use this knowledge to your advantage.

Testimonials – One of the best ways to determine which divorce lawyer would be good for your divorce is to learn what former clients have to say about a particular lawyer. Don’t be afraid to ask around. If you do not know of anyone who has been a client of that particular divorce lawyer, at your initial appointment don’t be shy to ask your prospective lawyer for a list of past clients. While client confidentiality is very important, any “good” and experienced divorce lawyer would not be hiding anything and would have at least a few satisfied former clients who would be willing to vouch for him or her.

Accessibility and the “Likeable” element – It is extremely important that your divorce lawyer is easily accessible and prompt in responding to your phone calls, emails, and requests. Or, you’re going to get nothing but frustration. While you would care to ask for the lawyer’s office policy, don’t forget to ask the lawyer’s past clients if that particular lawyer was responsible enough to maintain an easy system of communication. And last but not least, do YOU personally like that particular divorce attorney? Do you feel comfortable talking to that lawyer, and are you confident in his or her abilities? If the answer is anything other than a definite “yes,” you need to keep looking. Your case is too important to entrust to someone who does not inspire your confidence. If you don’t like that particular lawyer for some reason and don’t feel comfortable talking to him or her, there might be other people (like the judges) that may not like that person for the same reason that you do, which may cause you to lose the case.

There are several subjective misconceptions regarding the role of lawyers in society. Many conceived that a lawyer only deals matters of law at all times.

There were also suspicions that lawyers are expert in the unfamiliar underground world of red tape in government. To some, they unfavorably settle that lawyers are the creator of trouble that aggravated issues.

These were all misconceptions with no definitive truth. In reference to Los Angeles lawyers, these are whole lies.

On the positive side, the true role of the lawyer in society is the facilitation in the dispensation of impartial justice. A lawyer is an advocate of justice. He had inculcated in his being a higher sense of morality.

Enough for the characteristic angle, Los Angeles lawyers have varied roles portrayed in our society. Lawyers help people not only on their legal predicaments but also in different kinds of problems, whether in their business or even daily endeavors.

To be specific, it would be wise to illuminate on the job as well as the attributes of lawyers in general.

Lawyers represent clients in their legal issues. They represent clients in their civil, criminal cases in courts or administrative litigations before government functionaries or private tribunals. A lawyer renders advice also in non-contentious cases, like business, finance, taxes, employment issues and other transactions.

Further, lawyers are counselors. Lawyers generally render advice to clients concerning their liability claims, legal rights, duty or obligations, advise on their respective lawsuits (whether for prosecution or defense) including their business transactions.

As part of their learning and profession, they are master analyzer. Lawyers are masters in interpreting laws or statutes, ordinances, court rulings or legal precedents, administrative regulations or circulars. They analyze cases and predict its outcomes from inception to finish.

Lawyers are skilled writers. As part of the daily duties of lawyers are drafting of varied kinds of documents ranging from contracts, commentaries, pleadings, summary of cases, interpretative articles, journals, legal briefs, memorandum and legal books. Of course, they know the mechanics in preparing and drafting legal documents, such as deeds, wills, patent applications, mortgages and leases.

Lawyers are legal officers. A lawyer, after hurdling the bar and consequently taking the oath and become licensed are officers of the court. They belong to the privileged few who are entitled to represent a client in court and to the magistrate or juries.

Lawyers are master tactician. Lawyers know how to use the law in a given situation. They can readily find ways to develop strategies and arguments in the presentation and preparation of their client’s case. They master the tactics of winning a case within permissible limits without bending or breaking the law or legal procedures.

Lawyers are great investigators. Evidence gathering, interviewing witnesses and examination of data are some of the specialties of lawyers.

Lawyers are negotiators. They are best negotiators in varied civil disputes or in insurance claims settlement or employment deadlock, collective bargaining and any other settlements.

Lawyers are capable of multi-tasking. Lawyers not only portray as legal personality in courts, but also they act as agent, trustee, guardian, or executor and administrators of estate.

The above statements are not only precepts but also a definitive truth. These were all the synopsis of the attributes of lawyers, specifically I mean, of Los Angeles Lawyers.

Specialization, a Huge Word in Los Angeles Law Firms

As defined, a law firm is a business entity, which was formed by one or more lawyers to engage in the practice of law. It is an office where all the functions of an advocate are exercised, and where the regular course of business dealings of a lawyer is performed.

Just like any other law firms, Los Angeles Law firms impart legal services. They are the same with respect to the constitution, creation, and its components.

The difference lies mainly in the manner of their specialization. There are plenty of law offices in Los Angeles, as there are lawyers. Each law firm has its own line of expertise, just as a medical practitioner has its own specialization.

In Los Angeles, a great number of schools have sanctioned special programs of study akin to undergraduate majors. General practitioners in the legal profession have become less common, it had lost its trend in the legal career.

Specialization has become the trend of the future. Most schools in Los Angeles have now offered a formal program of specialization in a given area of the law. Some schools, however, keep specialization informal.

In present times, considering that the law is complex and has a variety of areas, it is a common practice nowadays, that a lawyer or law firm for that matter have a field of specialization.

Some Los Angeles law firms cater legal services in the area of torts-under it; we have personal injury, of family laws, of labor laws, mercantile law, banking laws, admiralty, taxation laws and other areas of law. Some firms are more inclined to specialize in criminal law and constitutional law.

The abovementioned areas of law are composed of several parts. Each part can be subject to specialization. As if for instance, in the area of family law, we have specialization in adoption laws – which cover inter-state and inter-country adoption, child custody, divorce, domestic violence and child support.

The evolution of specialization in the law profession brought so much change. General practice of law has lost its demand and utility. Specialization marks the set up of future law firms.

In Los Angeles, big law firms handled specialized cases. It is manifest how successful their venture to a particular special area of law. Some law firms in Los Angeles have become well known and had a full load of clientele. Some even becomes the authority in a particular area of law.

An observation could conclude that the profession has changed its course, so as the movement of law firms.

With this set up, the focus is concentrated on the specialized field. The efforts of a lawyer in attending to a clients cause are maximized. Consequently, the clientele has become limited.

The specialization broadened the knowledge of a lawyer to a particular field of law. The parameters are defined and it is expected that a high-level of practice be observed. The legal practice had become limited but effective.

These had become the prevailing practice in the law profession, especially in Los Angeles. Specialization had become the watchword in the legal profession.

Our Los Angeles law firm specializes in handling cases involving personal injury, employment law, social security and business law. Just link on our website and learn more about our distinguished team of expert lawyers.

Lawyers and Pirates

I have been surprised since writing my novel, “SILVER — My Own Tale As Told By Me With A Goodly Amount Of Murder”, by a particular question that readers have asked and the frequency with which it has been asked.  The question assumes different forms, but it is chronic: “What is the difference between pirates and lawyers?” The question is always asked with a smile and the audience consistently responds with a laugh.  I don’t resent the question or the person asking it.  I do resent the popular (perhaps even pop) notion that lawyers are little more than pen-wielding cutthroats sailing on sheaves of legal-sized paper. Lawyers are the opposite of pirates.  We uphold the law and are required to abide by strict ethical standards.  Our duty to our client is high.  Yet, we have become a punch line — an easy laugh.  Why?  When did the opinion about lawyers change from respect to disdain? (Dickens took a shot at lawyers; however, he apparently distrusted anyone that hadn’t spent time in a workhouse or a debtor’s prison.  Shakespeare, famously, had one of his comic characters tell another comic character to kill all the lawyers, but the bard was distinguishing between lawyers, the law and justice.) I suppose that a person might respond to the question by pointing out the vigor with which lawyers pursue their clients’ interests.  Pirates, on the other hand, tend to use their cutlasses to pursue their own interests: robbing, ransoming and murdering. We are a litigious society, and many who have been on the losing end of a battle, or have been grilled during testimony, leave the courtroom, boardroom or conference room angry at their treatment.  I recently spoke with a doctor that had suffered the indignation of an investigation into his treatment of a patient, and complained about the ruthlessness of the legal team questioning him.  He emphasized that he, who had only seen the patient once, was under attack, and added that the patient — which died — had a low life expectancy anyway.  Lawyers must discern the facts in order to distinguish truth from trickery.  I told this to the doctor and he, without a touch of irony, replied that when the case concluded and he “won”, he intended to bring an action against the plaintiff.  I asked him if he was going to hire an attorney.  “Hire an attorney?  Of course,” he replied. Pirates are not known for seeking out truth and justice.  They traditionally shy away from courtrooms because of their aversion to hanging. Greed.  My experience is that greed, like gluttony, crosses all socioeconomic barriers on land and sea.  Lawyers expect to be paid for their services.  The market determines how much a lawyer can charge.  If a client believes that a lawyer’s hourly rate is too high, the client is free to hire a different lawyer that charges less.  There are lots of lawyers and lots of rates.  Not all lawyers are created equal, and the client knows this, and so rarely picks a lawyer based solely on rate. Pirates do not take what the market will bear.  They just take. Some lawyers make a good living and other lawyers barely make ends meet.  Lawyers, just like non-lawyers, are often out of work because of cutbacks and economic forces beyond their control.  The practice of law may be a calling, but it is also a job.  Lawyers hope that if they work hard they will make a lot of money.  (It’s called capitalism and it seems to work.) Pirates are not to my knowledge subject to market forces.  They plunder at every opportunity, during both good and bad times.  I’m not sure that piracy is as much a calling as it is a form of sociopathological behavior. Here’s a fact that may help dismiss the correlation between lawyers and pirates: lawyers work for free.  That’s right.  Lawyers do pro bono work, assisting individuals and organizations that cannot afford to pay for legal services.  Law firms encourage pro bono work.  Lawyers and law firms donate to charities that help members of society. Pirates prey on rich and poor alike.  They murder those that cannot pay for their “services”. I have to write about tort reform, as lawyers’ unwillingness to support this populist notion makes them mercenaries in some people’s minds. Richard Nixon, not the poster boy for . . . well pretty much anything in America, let alone economic acumen, imposed wage and price controls in the Seventies and was properly vilified for it.  Wages and prices skyrocketed once the government thumb was removed from the free market.  (I wonder if government mandated Medicare caps are a source of the inflation of medical costs.)  Amazingly, politically conservative politicians want tort reform.  Conservatives should be marching against tort reform as a form of government mandated wage controls, not to mention a hallmark of Socialism. Liberal politicians like tort reform too.  I expect that it makes them feel good: nobody should make too much money, unless it can be taxed and redistributed.  I believe that is in the liberal politician handbook. Conservatives and liberals both want tort reform, so why don’t we have it?  Simple.  Lawyers are civic-minded and won’t contribute to any campaign that would curtail their livelihood.  Is this wrong?  Not really.  I have no doubt that bakers would raise their rolling pins in anger and contempt if politicians tried to tamp down the price of baguettes.  Just ask Marie Antoinette. Pirates adore wage and price controls, as it gives them a free hand to set up black markets.  They might even encourage people to sign petitions for wage and price controls, which would be a step toward bringing pirates into the political system.  Pirates might, in time, even vote — for corruption of course. Attorneys can be — and this is true — full of bluster.  Sort of like pirates . . . There is a key difference though: lawyers rant and rage to put matters right rather than to make matters wrong.  This difference, no doubt, is a small one to those that prefer their falsehoods unleavened by accuracy. There are those that say that lawyers are arrogant.  Certainly some lawyers may seem and actually be arrogant.  A waiter once hunched over me and demanded that I try the prawns that he set on the table.  I explained to him that I did not eat prawns.  He refused to move from my side and I refused to eat his prawns.  I found him arrogant, especially when he charged my host for the prawns that I did not eat. Pirates, like some lawyers, some waiters and a good number of other people, are arrogant.  Nobody has cornered the market on arrogance yet, although late night talk show hosts that perpetuate punch lines about lawyers while railing against the employers that pay them a pretty good buck, seem to have a strong head start on the rest of us. So, are lawyers like pirates?  Hardly. The pen is not only mightier than the sword, but it usually forms the letters that spell justice.©2008 Edward Chupack

Law of Vibration ? the Key to Understanding the Law of Attraction

Of all the universal laws, the law of attraction is both the most fascinating and the most misunderstood. Fascinating, because as humans we naturally want a tool to help create the life of our dreams, and the law of attraction can certainly help us to do that. Misunderstood because, unlike a tool that we can pull out and use now and again but is otherwise inactive, the law of attraction is operating in our lives constantly and independently, whether we are consciously aware of it, or believe in it, or not.

In other words, there is no need to engage the law of attraction, it is already at work in your life and always will be. So long as you are alive and breathing, the law of attraction is at work. This is great news! You are already using the law of attraction to create everything in your life whether you realise it or not. The results that you are experiencing: your career, finances, relationships, health, home, community, and so on, are a direct result of the law of attraction and your interaction with it in the form of thoughts and feelings.

If you’re not creating the kind of life you want though, chances are you are creating by default, allowing the law of attraction to bring you more and more of the same. Unfortunately, we weren’t handed a life manual at birth and, for many of us, our parents were not aware of the law of attraction and so did not teach us.  At Attract Like Magic we are dedicated to helping you understand this powerful universal law and how you can begin to use the law of attraction to consciously create the life of your dreams. On the Attract Like Magic site, and in upcoming newsletters and articles, we will explore everything to do with the law of attraction and provide tools that will help you to harness its power.

But in order to really understand the law of attraction, you first need to understand another of the universal laws, the law of vibration.

Law of Vibration

According to the law of vibration everything is made of energy and has a distinct frequency or vibration. With the advent of powerful enough technology, science now agrees. Quantum physicists have shown that, although matter may appear to be solid, when you look at it through a high-powered microscope so that it is broken down into its smallest components: molecules, atoms, neutrons, electrons and quanta (the smallest particles measurable), it is ultimately mostly empty space interspersed with energy.

In other words, at the quantum level, everything is comprised of energy and empty space and what makes you, your home, your car, the chair you’re sitting in, seem solid is the frequency of the vibration of the energy that makes it up.

Not only does your body and all that you consider to be “you” have a distinct and unique vibration (or more correctly a mix of vibrations), but your creations, in the form of thoughts, also have distinct vibrations which affect or blend with your overall vibration.

In turn, your vibrations affect everything around you – your environment, the people and animals around you, the inanimate objects, even the seemingly ‘empty’ space and they, in turn, affect you. That’s why, when you walk into a room where there was an earlier argument, you can sense it. We even use terms like “bad vibes”, “you can feel the tension”, and “you could cut the air in here with a knife” to describe it. In each case what we are referring to is the energy imprint of the earlier occupants.

Similarly, you may have gone to someone’s home, office or business where, as soon as you entered, you felt the “good vibes” that filled the place. That’s because, over time, a place becomes imbued with the energy imprints of the dominant vibrations of the people who live or work there. So a home, for example, can literally become filled with love or tension or anger or sadness or any other emotion, and that home will feel that way to a visitor even if none of the regular occupants are at home at the time. If you’ve ever entered such a place you may even have noticed how you just relaxed and felt good in response to the “good vibes” around you. Of course, the extent to which you take on the vibrations of the people and things around you is up to you – but for most people, this is not a conscious decision.

So, you are giving off vibrations every second of every day. You are also simultaneously receiving and translating the vibrations of everything and everyone around you. If we use the analogy of television, you are both a television transmitter, beaming out your own unique station, and also a television set or receiver, able to tune in to all the stations or frequencies being broadcast around you. Sometimes we refer to these incoming vibrations as intuition or “gut feelings”.

So how do you know what your vibration is at any moment?

Simple – ask yourself how you are feeling.

Your emotions are a quick and handy guide to your vibration in any moment. If you feel loving, you are vibrating at the frequency of love; if you feel angry, you are vibrating at the frequency of anger; if you feel curious, you are vibrating at the frequency of curiosity, and those vibrations are received by everything and everyone around you. You are also, through the law of attraction, bringing to you more experiences that will match this vibration so when you feel angry the law of attraction will bring to you more experiences that will elicit the feeling of anger, you will attract angry people and find yourself in the middle of angry situations.

Have you ever had a day where you felt lousy, but tried to pretend that everything was OK to family, friends or co-workers? It doesn’t work does it? Your friends, family or co-workers know straight away that you are not how you are pretending to be. They may ask if something is wrong, or comment that you don’t seem to be your normal self. They pick up on the incongruence between what you are saying and your vibration. Because we are not used to explaining in terms of vibrations, they may attribute their knowing to something more mundane like tone of voice or body language, but even people without the full use of their senses can detect this type of incongruence.

To sum up, you are sending out vibrations every moment of every day. Those vibrations are a mix of your thoughts and feelings and they affect everything around you. At the same time you are also receiving and translating the vibrations of everything around you (which can, in turn, affect your vibration by how you react to them). Now that we understand vibration, let’s look at how it interacts with the law of attraction.

Law of Attraction

The law of attraction, simply put, means energy attracts like energy. You may also have heard it expressed as “like attracts like’, “that which is like unto itself is drawn” and even “thoughts become things”.

The law of attraction is at work in your life every minute of every day. Your vibrations are constantly being broadcast to, and received, by the universe. This activates the law of attraction which then matches your vibrations and attracts to you similar vibrations in the form of people, things and situations in your life. In other words you are always creating your life through your thoughts and feelings. The conditions in your life, whether they are what you want or not, are always a match to your dominant vibrations.

The law of attraction, like all the universal laws, operates whether you are aware of it or not, or believe it or not. The often-used terms “what you focus on grows”, “careful what you wish for (cause you just might get it)”, “birds of a feather flock together” and “you can’t get enough of what you don’t want” are all examples of ways that we describe the law of attraction in action.

So, the question becomes – if your life is not how you would wish it to be, how do you change it? And the answer most often given by law of attraction and personal development teachers is a simple one – change your thoughts.

Simple – yes, but not easy. Here’s why.

Somewhere between 94 – 98% of all thoughts are subconscious, that is, below or out of conscious awareness which means that only 2 – 6% of your thoughts are ever conscious. So, even if you managed to change all of your conscious thoughts to be positive, that still leaves an awful lot of subconscious thought, at least some of which would be negative, vibrating away in the background without you even being aware of it! If you’re having trouble creating what you want in life, chances are your subconscious mind is at fault.

In our next article we will explore the subconscious mind and how it can interfere with your Law of Attraction efforts.

Top Rated Malpractice Attorneys in Los Angeles

You may find it hard to believe that there are attorneys who take up cases against their fellow attorneys. But there are. These attorneys are known as legal malpractice attorneys. They take up those cases where an attorney is accused of malpractice, negligence or breach of contract that causes financial or other kinds of damage to the client.
These cases are not few. According to reports, a malpractice case is filed against five to six percent of US attorneys every year. This keeps the unscrupulous attorneys on guard because no one wants to be dragged to the court. Litigation is very time consuming and it costs a lot of money. If possible, you do not want to go to court, and you definitely do not want to go to court with an attorney who is not legally suppose to handle medical malpractice cases. Many attorneys try taking these cases because there are certain circumstances that will benefit the attorney instead of the client.
So, what are the most common grounds on which the malpractice attorney builds the case? These include the way witnesses were presented or not presented; the way the cross examination was conducted; the way the defendant- attorney followed deadlines.
There are also occasions where an attorney may force a client to make an out-of-court settlement for reasons that benefit the attorney and not the client. It is these, and many more similar cases, that the legal malpractice attorneys in Los Angeles take up to ensure that the legal black sheep don’t go unpunished.
The legal malpractice attorney can easily be approached by clients who are victims of unscrupulous attorneys. They can do so by locating the addresses of Los Angeles malpractice attorneys on the net or by obtaining their contact number and address from yellow pages. It is also a smart thing to browse top law firms on the net that post customer testimonials or past successful cases. You can then call the clients and interview them about their experience.
The legal malpractice attorneys Los Angeles have to work hard if they have to undo the damage. They need to prove beyond doubt that the defendant had a clear client-attorney relationship with the plaintiff; that the defendant breached this trust; that the plaintiff suffered on account of this; and now the plaintiff needs to be compensated for this injury. The skills of the malpractice attorney also lie in establishing the compensation amount and giving convincing reasons why it should be awarded.

E-Verify is an Internet-based system operated by Department of Homeland Security (DHS/U.S. Citizenship and Immigration Services (USCIS) in partnership with the Social Security Administration (SSA). E-Verify is currently free to employers and is available in all 50 states. E-Verify provides an automated link to federal databases to help employers determine employment eligibility or work authorization of new hires and the validity of their Social Security numbers.Employers or “Designated Agents” (e.g., payroll companies) must register online and agree to the terms of participation to use E-Verify. [Registration includes agreeing to the DHS/Immigrations and Customs Enforcement (ICE) Memorandum of Understanding (MOU). A discussion of the ICE E-Verify MOU is outside the scope of this post.]E-Verify will soon be required of all federal contractors. DHS is now promulgating “final” E-Verify regs. I present an E-Verify overview and update in this post.
